Prosecution breaks down into Civil or Criminal prosecution; the two are not mutually exclusive. Under Civil action you can claim damages from the person/organisation that has infringed your IP rights. Criminal prosecution will result in the person/organisation being fined or imprisoned. In the UK criminal action is normally initiated by Trading Standards or a local authority.
