Website Take Downs

It is possible in the US under the Digital Millennium Copyright Act (DMCA) to have a web site taken down that contains copyright material by sending a Cease and Desist Letter to the ISP hosting the site.

In other countries of the world there is discussion of similar Acts but none yet have the teeth of the DMCA.

This does not mean that an ISP cannot be approached and presented with evidence of copyright or trademark infringement and asked if they will take down the site or as a minimum remove the infringing content.

It is not always necessary to take down a whole web site, for example, in the case of auction and trade board sites. If an infringing item is identified most of these sites have a procedure for removing these listings when presented with the appropriate evidence.
